Introduction

Welcome to Bunifu Go. These terms and conditions govern your use of the Bunifu Go software, including all associated websites, apps, media, printed or electronic documentation, updates, and support services related to the software, provided by Bunifu Technologies (“we”, “us”, “our”). By installing, copying, downloading, accessing, or otherwise using Bunifu Go, you agree to be bound by these terms. If you do not agree to these terms, do not use this software.

Software License

a. Grant of License: This Agreement grants you a non-exclusive, non-transferable license to install and use the software strictly in accordance with the terms of this Agreement. Note; the license may be executed in a contract as provision of a specific service.

b. Restrictions: You may not:

• Modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of the software.
• Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the software or any part thereof.
• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the software, or any features or functionality of the software, to any third party for any reason.

c. Compliance with Applicable Laws: You are responsible for complying with all applicable laws in using this software. These terms shall be deemed to have been made, executed and delivered in accordance with the laws of the republic of Kenya.

Intellectual Property Rights

The software and all copyrights, trademarks, patents, trade secrets, and other intellectual property rights associated therewith are, and shall remain, the exclusive property of Bunifu Technologies. This Agreement does not transfer from Bunifu Technologies to you any Bunifu Technologies or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Bunifu Technologies.

User Content

In these terms and conditions, “User Content” refers to any data, content, or material that you upload, transmit, or store through the use of the software. You grant Bunifu Technologies a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such User Content in any existing or future media for any purpose.

Updates and Maintenance

Bunifu Technologies may from time to time provide enhancements or improvements to the features/functionality of the software, which may include patches, bug fixes, updates, upgrades, and other modifications (“Updates”).

Review our Privacy Policy which explains how we process any personal information you provide to us.

Data Protection

Compliance with Data Protection Legislation: We at Bunifu Go agree to comply with the Data Protection Act, 2019 (Kenya), and any other applicable data protection laws and regulations. This includes adhering to principles relating to processing personal data, such as obtaining consent, ensuring accuracy, minimizing data collection, and respecting user rights.

Data Handling and Security: We shall implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including protection against unauthorized or unlawful processing, accidental loss, destruction, or damage of data. Measures include encryption, access control, secure data storage, and regular cybersecurity assessments.

Termination

This Agreement is effective until terminated. You may terminate this Agreement at any time by ceasing to use and destroying all copies of the software. It will also terminate immediately if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the software and destroy all copies of the software in your possession.

Warranty Disclaimers

The software is provided to you “as is” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Bunifu Technologies, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the software, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Bunifu Technologies or its affiliates, or any of its or their respective licensors or service providers, be liable for any special, incidental, indirect, or consequential damages whatsoever.

Modification

We reserve the right to modify these terms and conditions at any time. Your continued use of the software after such modifications will constitute acknowledgement and agreement to the modified terms and conditions.

Force Majeure

Neither party shall be liable for any failure of or delay in the use of Bunifu Go software for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders or any other force majeure event. In the event of such delay, the date of delivery or time of completion will be extended by a period of time reasonably necessary to overcome the effect of any such delay.
